This Privacy Policy describes how your personal information is collected, used, and shared when you register with, access, or use the SHORE PASS application and related services (the "Service" / "Application Software"). Our Application Software follows applicable legal requirements to protect your privacy. This Privacy Policy explains how we may collect information from you, how we may use and share that information, and how you can limit our sharing of your information. As SHORE PASS operates globally, this Policy is designed to align with major data-protection frameworks, including the EU General Data Protection Regulation (GDPR) and India's Digital Personal Data Protection Act, 2023 (DPDP Act).
Definitions
- Personal Data — any information relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to that person's physical, physiological, genetic, mental, economic, cultural, or social identity.
- Usage Data — data collected automatically, either generated by use of the Service or from the Service infrastructure (for example, the duration of a page or screen visit within the Application Software).
- Cookies — small pieces of data stored on a User's device.
- Data Controller — the natural or legal person who, alone or jointly with others, determines the purposes and means of processing personal data. For the purpose of this Policy, we are the Data Controller of your data.
- Data Processor (Service Provider) — a natural or legal person who processes personal data on behalf of the Controller. We may use various Service Providers to process your data more effectively.
- Data Subject — any living individual who is the subject of Personal Data.
- User — the individual using our Service. The User corresponds to the Data Subject.
Information We Collect
We collect several different types of information when you register on our Application Software, subscribe to communications, fill out a form, or use our Service. Some services may require you to provide personal data.
Device Information. When you visit or use the Application Software, we automatically collect certain information about your device, including your web browser or app version, IP address, time zone, unique device identifiers, and some of the cookies installed on your device. As you browse, we also collect information about the screens or products you view, what referred you to the Service, and how you interact with it. We collect Device Information using technologies such as:
- Cookies — data files placed on your device, often including an anonymous unique identifier. For more information about cookies and how to disable them, you may visit a reputable cookies-information resource.
- Log files — which track actions occurring on the Service and collect data including your IP address, browser/app type, internet service provider, referring/exit pages, and date/time stamps.
- Web beacons, tags, and pixels — electronic files used to record information about how you browse the Service.
Account & Order Information. When you register, or make or attempt to make a purchase through the Service, we may collect information including your full name, gender, date of birth, email address, phone number, billing and shipping address, payment information, real-time location, device information, and Usage Data.
When we refer to "Personal Information" in this Policy, we mean both Device Information and Account & Order Information.
How We Use Your Personal Information
We use the information we collect for various purposes, including to:
- fulfil and manage orders or services placed through the Service (including processing payments, arranging delivery, and providing invoices or confirmations);
- personalise and improve your experience and our Application Software;
- improve customer service and respond to your support requests;
- send periodic communications about order processing, organisational news, updates, and — where in line with your preferences — marketing or promotional materials and information about goods, services, and events similar to those you have purchased or enquired about;
- provide and maintain our Service, and notify you about changes to it;
- enable you to participate in interactive features when you choose to;
- gather analysis and valuable information so we can improve our Service;
- monitor usage of the Service and detect, prevent, and address technical issues; and
- screen orders and activity for potential risk or fraud (in particular using your IP address).
We log information such as when you use and last visited the Application Software, the services and content you use or view, and the time, frequency, and duration of your activities, in order to improve the Service offered to you. If you choose to withhold personal data we request, it may not be possible for you to access certain parts of the Service or for us to respond to your query. You may opt out of any or all marketing communications by following the unsubscribe link or instructions in any email we send.
Sharing & Disclosure of Your Personal Information
We do not sell, trade, or otherwise transfer your Personal Information to outside parties, except as described in this Policy. We may share your Personal Information with trusted third parties who assist us in operating the Application Software and serving you better — for example, hosting, payment, analytics, and support providers — provided they agree to keep this information confidential and use it only to perform services on our behalf.
We may also disclose your information, including Personal Data, to third parties where reasonably necessary to:
- comply with any applicable law, regulation, legal process, or appropriate government or lawful request (such as a subpoena or search warrant);
- protect any person from death or serious bodily injury;
- prevent fraud or abuse of the Application Software, our services, or our Users;
- protect our rights, property, safety, or interests; or
- perform a task carried out in the public interest, or as otherwise stated in this Policy.
Third-Party Links
At our discretion, we may include or offer third-party products or services within the Application Software. These third parties may have separate and independent privacy policies, and we advise you to review them before using such sites or services. We are not responsible or liable for the content and activities of these linked sites, though your feedback regarding them is welcome.
Behavioural Advertising & Marketing
We may use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you, in line with your preferences.
Text / SMS Marketing. By subscribing to SHORE PASS text notifications, you agree to receive automated marketing text messages from us about our products and services at the phone number you provided, sent via an automatic telephone dialing system or other technology. Message frequency is recurring. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to opt out, and HELP for support. You may receive a confirmation message of your opt-out. Attempting to opt out by any means other than the commands above is not a reasonable means of opting out.
Do Not Track
Please note that we do not alter the Service's data-collection and use practices when we receive a Do Not Track signal from your browser.
How We Protect Your Information
We have implemented a variety of technical and organisational security measures — including access controls and secure storage — to maintain the safety of your Personal Information. No method of transmission or storage is completely secure, and you are responsible for keeping your account credentials confidential.
Payments
Certain features of the Application Software may be paid services for which you may be charged a subscription or service fee. In that case, we use third-party payment processors. We do not store your payment card details — that information is provided directly to our third-party payment processors, whose use of your information is governed by their own privacy policies. For payments, you may be diverted to other applications or websites not operated by us; we have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party service.
Children's Privacy
Our Service does not address anyone under the age of 18 ("Children"). We do not knowingly collect personally identifiable information from anyone under 18. If you are a parent or guardian and believe your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from a child without verification of parental consent, we will take steps to remove that information from our servers.
Cookies & Tracking
We use various technologies to collect and store information when you use our Service, including cookies and similar technologies to identify your browser or device (computers, phones, connected TVs, and other web-connected devices). Cookies are files with a small amount of data that may include an anonymous unique identifier, sent to your browser (if you allow) and stored on your device, enabling the Service or its providers to recognise your browser and remember certain information.
We use cookies to understand and save your preferences for future visits and to compile aggregated data about traffic and interaction, so we can offer better experiences and tools. We may engage third-party providers to help us understand our Users; they are restricted to using the information only to help us improve our Service. You also have the right to lodge a complaint with your local data-protection or supervisory authority (such as the relevant EU/EEA authority or the Data Protection Board of India). Because SHORE PASS operates globally, your information may be transferred to, and processed in, countries other than your own, including India, where our servers or Service Providers are located; where required, we apply appropriate safeguards for such transfers.
Data Retention
When you place an order or register through the Service, we will retain your information for our records and to comply with our legal, tax, and operational obligations, unless and until you ask us to delete it.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will notify you of any changes by posting the updated Policy on this page and, where appropriate, via email or a prominent notice within the Service, and we will update the "Last updated" date above. You are advised to review this Policy periodically. Changes are effective when posted. This Policy applies to information collected through our Application Software and not to information collected offline.
